Program: Evolv OS SMS & Email Notifications
Evolv OS provides business management software to fitness, wellness, and performance practitioners ("Licensees"), including Evolv Method, a division of Performance Strength and Wellness LLC. As part of the platform, Evolv OS sends account, billing, and subscription messages to Licensees, and provides Licensees the infrastructure to send text messages and emails to their own clients under their own business name. Client messages include transactional messages (session reminders, scheduling updates, payment receipts and refund confirmations, and package balance reminders) and, only with separate optional consent, marketing messages (offers and renewal promotions).
By creating an Evolv OS account or using the Evolv OS platform, you agree to these Terms and Conditions.
Transactional message frequency varies based on your appointments, account activity, and billing schedule. Recurring messages may be sent. Marketing messages, if you opt in to them, are sent up to 4 times per month.
Message and data rates may apply. Check with your mobile carrier for details. Mobile carriers are not liable for delayed or undelivered messages.
Text messages: You opt in by entering your mobile number and checking an unchecked consent box on a sign-up or intake form. Transactional and marketing texts are opted into separately; marketing texts are optional, and consent to receive texts is not a condition of purchase. Reply STOP to any text at any time to opt out. You will receive one confirmation text, and no further texts will be sent unless you opt in again. Reply HELP for assistance.
Email: Every marketing email includes an unsubscribe link. To stop receiving emails, use that link or contact support@getevolvos.com.

Licensee practitioner businesses are responsible for obtaining proper consent from their own clients before sending communications through the Evolv OS platform, and for the accuracy of client contact information they enter into the platform.
Subscription fees are billed to Licensees on a recurring basis through our payment processor, Stripe. Client payments processed on behalf of Licensees are subject to Stripe's terms of service.
Evolv OS provides the platform "as is" and is not liable for indirect, incidental, or consequential damages arising from use of the platform, to the fullest extent permitted by law.
We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance.
